You all know where I stand on Burning Man, the Protector Of Rich Hippies (among other things). I stand as far away as possible, and not downwind.

But even I’ll admit that photo is terrific.

  1. This is an excellent response from a representative of Burning Man to the intellectual rights issues around photography at Burning Man.

    (As to Burning Man itself – as someone recently put so well: “Burning Man is not actually just about illicit or hedonistic activity. [ my note: though yum yum there is plenty there!] It’s really about community and personal expression, and through the tremendous personal investment and struggle that people go through to get to the desert, to survive there for a week, to create art there, and to be a member of the community, they learn a lot about themselves, and become better people.”) I’ve been 5 years in a row.

    @samiam and others baffled by the angle – she’s leaning forward a little bit, which is why her physiology looks abbreviated. The intent is to create something vaguely resembling the )'( symbol.

    @violet – The organizers of the burn are not the first group of well-meaning people to adopt an unnecessarily aggressive intellectual property policy. The important question is if and how they will choose to exercise it. If they harass people displaying images (with the consent of their subjects) for completely non-commercial use on sites like Flickr, then righteous indignation and public pressure should be brought to bear on them. If however they use it only to squelch the non-consensual publication of sniper shots taken by roving professional photographers of the naive and naked, then I doubt anyone would feel they are betraying the community. There’s plenty of gray area in this neighborhood, but it would be self-defeating to clamp down on the “radical self-expression” that is a core value of the event. All that said, for the record I’d also hate to be on the wrong side of anyone’s interpretation of the DMCA…

  3. I am now worried that Burningmaninc will come after me for displaying or disseminating one of their snatches “in a manner” that BMO “doesn’t like”. I mean, clearly they own the pussy because she bought a ticket. and since –

    “The BMO also limits your own rights to use your own photos and videos on any public websites, (1) obliging you to take down any photos to which BMO objects, for any reason; and (2) forbidding you from allowing anyone else to reuse your photos (i.e., no licensing your work no matter what is depicted, including Creative Commons licensing, and no option to donate your work to the public domain).

    Moreover, the Burning Man Terms and Conditions also strip attendees of their trademark fair use rights. The ticket terms forbid any use of Burning Man trademarks on any website, which means that ticket-holders can’t label their photos “Burning Man 2009” or even use the words “Burning Man” on their Facebook walls or Twitter updates.”

  4. LOL! I personally have had a ton of fun at BM in the past, despite the stink and the sweat and the hippieishness. Yes, this pic is awesome!! She should do a series of these, with landmarks in the background. I can see it now, cunt and Eiffel Tower, pussy and the Taj Mahal, Stonehenge, the Pyramids … So many options!
